Consumer are urged to apply for refund under settlement in generic drug price-fixing lawsuits

Consumers can check their eligibility for compensation under a recent settlement for certain generic drug purchases and submit a claim here. Businesses in Washington and Idaho are also eligible for payments.

Following lawsuits by a coalition of 48 states and territories, a federal court recently granted preliminary approval of a plan to distribute funds paid by generic drug manufacturers to settle claims they illegally conspired to raise generic drug prices.

“As a result of our efforts to hold generic drug manufacturers accountable for illegally conspiring to drive up prices, consumers may now be eligible to receive compensation,” California Attorney General Rob Bonta said in a statement. “I encourage anyone who purchased an eligible medication to take a few minutes to check their eligibility and submit a claim to recover money they may be owed.”

The coalition previously announced settlements with the manufacturers Glenmark, Lannett, Bausch, Apotex, Heritage, and Heritage’s parent company, Emcure, totaling about $96.5 million.

Consumers who purchased a generic drug listed here between May 2009 and December 2019, may be eligible for compensation. To determine eligibility, call 866-290-0182, email info@AGGenericDrugs.com, or visit www.AGGenericDrugs.com.

Washington and Idaho are the only states in the coalition that also obtained restitution for businesses impacted by the conspiracy. Businesses that indirectly bought one or more of the generic prescription drugs at issue in the states’ cases or provided reimbursement for some or all of the purchase price may be eligible for compensation. The timeframe for businesses is same as for consumers, May 2009 to December 2019.  For more information, visit https://www.aggenericdrugs.com/English/CorporateEntities.

The coalition of nearly all states and territories has been involved in a series of antitrust cases related to generic drug prices since 2016, some of which are still ongoing.

The cases are based on investigations that include evidence from witnesses with information about different conspiracies, millions of documents, and a huge phone record database. Each lawsuit addresses a different set of drugs and defendants, laying out an interconnected web of competing industry executives who regularly met and communicated with each other, providing the opportunity to form illegal agreements.
